Terms & Conditions (Players)

1) Who we are

These Terms & Conditions (“Terms”) govern your access to and use of the Padelytics application, website, and services (collectively, the “Service”) provided by Play Eye DOO, Sime Igumanova 25, Belgrade, Serbia (“Padelytics”, “we”, “us”, “our”). Trade and product name: Padelytics.

By creating an account or using the Service, you agree to these Terms.

2) Eligibility & accounts

• You must be old enough to use the Service under the law where you live. If you are in the EEA/UK, you must be at least the digital consent age set by your country (13–16; default 16) or have verified parental/guardian consent; in the US and most other countries, the minimum is 13. Do not use the Service if you do not meet the applicable minimum.
• You are responsible for your account credentials and for all activity under your account. Keep your password secure and notify us immediately of any unauthorized use.

3) What Padelytics does

Padelytics lets you record padel sessions (video), process them in our cloud, and view/share analytics and highlight clips derived from the footage. You can only see your own sessions and sessions shared with you with the consent of their respective owners.

4) Payment & pricing

• Pay-per-session. Purchases are processed by Lemon Squeezy, our merchant of record, which also handles taxes/VAT where applicable. Region-based pricing and promotional codes may apply.
• Refunds. If a purchased session fails due to a technical issue attributable to us and cannot be reasonably re-processed, contact office@padelytics.ai within 14 days with your order info; we may refund or credit at our discretion. This does not affect your non-waivable consumer rights.

5) Your responsibilities

• Permissions. You must only record and share sessions if you have the necessary permissions from participants and the venue. Do not upload or share unlawful, infringing, or privacy-violating content.
• Acceptable use. Don’t misuse the Service (e.g., reverse engineer, interfere with servers, bypass access controls, harass others, or use the Service for cheating or unsafe behavior).
• Making a session public. If you make a session public, you represent and warrant that you have obtained the consent of every participant appearing in it to publish their likeness, video, and match data, and you agree to indemnify Padelytics against claims arising from that publication. Public streams and replays are provided without guarantee of availability and may expire or be revoked at any time. Padelytics may remove, revoke, or refuse to serve any public stream at its discretion, including in response to reports. You must not record, re-stream, or redistribute a public stream outside the in-app features.

6) Content & IP

• Ownership. As between you and us, you retain the underlying rights to your personal likeness and any original material you capture via the Service. However, you agree that Padelytics owns (i) all derived data, telemetry, and analytics generated from your footage (the “Output”), and (ii) all Service software, AI models, and materials.
• Your License. We grant you a limited, non-exclusive, non-transferable license to view your sessions and share them via the in-app sharing features for your personal, non-commercial use, subject to these Terms. Downloading or extracting video/data outside the in-app sharing features is not permitted unless we explicitly enable it.
• Your License to Us. By using the Service, you grant Padelytics a perpetual, irrevocable, worldwide, and royalty-free license to host, process, adapt, and use your sessions and related materials. This includes the right to use the footage to develop, train, and improve our machine learning models and computer vision algorithms.
• Marketing license (opt-out). If you opt in (or where you have provided explicit permission), you grant us a license to use your name, clips, or testimonials for Padelytics marketing. You may revoke permission at any time by emailing office@padelytics.ai.

7) Privacy

We process personal data as described in our Privacy Policy. By using the Service, you acknowledge that policy.

8) Service changes and availability

The Service may evolve and may be interrupted for maintenance, updates, or events beyond our control. We do not guarantee uninterrupted availability.

9) Disclaimers

Padelytics analytics are estimates intended for training and entertainment. They are not medical or safety advice. To the maximum extent permitted by law, the Service is provided “as is” without warranties (including fitness for a particular purpose, accuracy, or non-infringement).

10) Limitation of liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, or loss of profits.
• Our total liability for all claims relating to the Service is limited to the amount you paid to us for sessions in the 12 months before the claim arose. Consumer rights that cannot be excluded by law remain unaffected.

11) Indemnity

You will indemnify and hold Padelytics harmless from claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your recording/sharing without required permissions.

12) Third-party terms

Payments are handled by Lemon Squeezy and are subject to its terms and policies. Cloud processing is provided via our vendors disclosed in the Privacy Policy.

13) Termination

We may suspend or terminate your access for breach, unlawful use, security risks, or non-payment. You may stop using the Service at any time. Certain sections survive termination (e.g., IP, disclaimers, liability limits).

14) Changes to these Terms

We may update these Terms. For material changes, we will provide notice (e.g., in-app/email) at least 7 days before they take effect, unless changes are required by law. Continued use after the effective date means you accept the changes.

15) Governing law & venue

These Terms are governed by the laws of Serbia. Courts in Belgrade, Serbia have exclusive jurisdiction, except where applicable consumer laws provide otherwise.
